Hilo Contest Rules – Win a Hilo Smart Home

1. CONTEST PERIOD
 
For the purposes of these rules (the “Contest Rules”), the Win a Hilo Smart Home Contest (the “Contest”) is being held by Hilo Services Inc. (the “Organizer” or “Hilo”). Only this Organizer is operating the Contest. The Contest begins at 1:00 p.m. on October 21, 2022, and ends at 4:59 p.m. on October 23, 2022, Eastern Standard Time (the “Contest Period”).
 
2. ELIGIBILITY AND REGISTRATION
 
The Contest is open to anyone aged 18 and over who is a resident of Quebec at the time of their registration in the Contest, except for any facilitator directly connected with the running of the Contest as well as any employee, administrator, manager, representative or agent of the Organizer or of one of their affiliated companies or subsidiaries or its advertising and promotional agencies, suppliers or consultants, their legal or de facto spouses, or anyone with whom such employees, administrators, managers, representatives or agents are residing. The Organizer reserves the right to verify the eligibility of any prospective winners.
 
3. HOW TO PARTICIPATE

To participate in the Contest and earn a chance of winning the Prizes (described in Section 5 of these Contest Rules), you must:
 
By submitting the Entry Form, each participant agrees to be bound by these Contest Rules. The completed Entry Form becomes the exclusive property of the Organizer and will not be returned to you. You will not receive any acknowledgement of receipt of your Contest registration and proof of your registration’s transmission will not be considered to be proof of its reception. The Organizer refuses any obligation to notify a participant whose Entry Form is either incomplete or inconsistent.
 
Furthermore, if the participant does not want to subscribe to the Newsletter to participate in the Contest, they can still register in the Contest and earn a chance of winning the Prizes by submitting a letter comprised of a minimum of one hundred (100) words explaining why they would like to win a smart home and an Electric Circuit credit (the “Letter”). The participant must clearly and legibly indicate at the end of the Letter their first name, last name, telephone number, email address and postal code. To be eligible to participate in the Contest, the Letter must be sent to the email address provided below before the end of the Contest Period: marketing@hiloenergie.com
 
A maximum of one Letter per person will be accepted for the purposes of registering in the Contest. By submitting a Letter, each participant accepts to be bound by these official Contest Rules, which are available online on the Website. All Letters become the exclusive property of the Contest Organizer and will not be returned to participants. Participants will not receive any acknowledgement of receipt of the Letter. The Contest Organizer refuses any obligation to notify a participant whose Letter is either incomplete or inconsistent. The Contest Organizer will not be held responsible for any Letter that is sent late or which is invalid, incomplete or has an incorrect address, all of which will be excluded from entry.
 
4. LIMITATIONS
 
Contest participants will respect the following limitation, otherwise they risk being disqualified:
 
  • Limit of one (1) Entry Form per person and per email address during the Contest Period. More specifically, each participant can only use a single email address to participate in the Contest, irrespective of how many email addresses are possessed by the participant.
All Entry Forms are subject to verification. If the Organizer discovers that a participant has attempted to (i) submit more than one Entry Form during the Contest Period, or (ii) has used more than one email address to participate in the Contest, this participant, at the sole discretion of the Organizer, will be disqualified from participating in the Contest and all Entry Forms from this participant can be declared ineligible for the purposes of participation in the Contest. The Organizer reserves the right, at its entire and sole discretion, to require proof of identity and eligibility in the Contest from any participant in the Contest and in such form as is considered acceptable to the Organizer. Failure to provide such proof before the required deadline will lead to disqualification of the participant.
 
5. PRIZE
 
One (1) winner will win the prize available, selected by draw from amongst the valid Entry Forms. The winner will win one credit from Electric Circuit with a value of $50 as well as one of the following bundles corresponding to the size of their home and their needs, which will enable the Winner to access the Hilo smart home service (collectively referred to as the “Prizes”):
 
  • Option 1: One (1) Small Home bundle including from one (1) to five (5) smart thermostats, up to four (4) connected devices, one (1) Hilo hub and the mobile application; a three-year (3-year) commitment to participate in Hilo challenges; installation by a certified electrician.
  • Option 2: One (1) Medium Home bundle including from six (6) to ten (10) smart thermostats, up to six (6) connected devices, one (1) Hilo hub and the mobile application; a three-year (3-year) commitment to participate in Hilo challenges; installation by a certified electrician.
  • Option 3: One (1) Large Home bundle including from eleven (11) to twenty (20) smart thermostats, up to eight (8) connected devices, one (1) Hilo hub and the mobile applications; a three-year (3-year) commitment to participate in Hilo challenges; installation by a certified electrician.
The connected devices can be selected from amongst the following:
 
  • Smart In-Wall Switch
  • Add-on Switch (3-way or more)
  • In-Wall Smart Dimmer
  • Smart Plug-In Switches
The winner must read and comply with the Hilo smart home service conditions available here: https://www.hiloenergie.com/en-ca/legal/entente-du-participant-contrat/ (the “Participant Agreement”) If the winner’s residence is not eligible for options 1 to 3 indicated above, the winner may, within [60 days following the transmission of a non-transferable promotional code], place an order for any other service or device sold by Hilo and take advantage of a maximum credit of $200 for this order.
 
6. PRIZE VALUES
 
The Prize values are as follows:
 
  • The Electric Circuit credit is worth $50
  • The Small Home bundle is worth $200
  • The Medium Home bundle is worth $340
  • The Large Home bundle is worth $480
  • The credit balance in the winner’s customer account will be $0
  • The credit applied to an order by a winner whose residence is not eligible for the Hilo services listed above has a maximum value of $200.
7. DRAW
 

Throughout the Contest Period, one (1) eventual winner will be selected by random draw by the Organizer from amongst the eligible Entry Forms received in the following manner: the draw will be held forty-eight hours (48 hours) after the end of the event, on October 25, 2022, at 9:00 a.m. (ET). A single person will be declared the winner of this draw (the “Draw”).

he Draw will be held at Hilo’s office in Montreal, in the province of Quebec. Within seventy-two (72) hours following the date of the Draw, the eventual winner will be contacted using the contact information provided on their Entry Form for the purpose of informing them that they are eligible to win one of the Prizes (the “Prize Notification”). If the eventual winner fails to respond or follow up on the Prize Notification within the forty-eight (48) hour period, or if they do not comply with these Contest Rules, this person will therefore be disqualified and another eventual winner will be randomly selected. Any returned Prize Notification that could not be delivered may result in a disqualification and another eventual winner may be randomly selected. The Entry Forms declared to be winners for the purposes of the Draw cannot be used for subsequent draws held for this Contest or for any other future contest or draw held by the Organizer.

 
8. CHANCES OF WINNING
 
The chance of a participant’s Entry Form being randomly selected to win the Prize depends on the number of entries received during the Contest Period.
 
9. AWARDING OF PRIZE
 
In order to be declared a winner and claim their Prize, those randomly selected for a Prize must:
 
  • tick the box on the Entry Form indicating they have carefully read these Rules;
  • sign the Declaration and Release Form and return it to the Contest Organizer before November 9, 2022;
  • verify their eligibility for the Hilo smart home service at www.hiloenergie.com/en-ca/become-client/register/ and confirm that the verification has been completed in the Declaration and Release Form;
  • correctly answer the mathematical skill-testing question provided in the Declaration and Release Form.
  • In case of a failure to fulfill one of the conditions included in these Rules or to be reachable within the prescribed time period, or if the Prize is refused, the winner will be disqualified and will not have any right to a Prize. In such a case, the Contest Organizer may, at their discretion, cancel the Prize or proceed with a new draw, according to the process established in these Rules, up until a participant is designated and declared a winner.
Upon reception of the duly signed Declaration and Release Form, the Contest Organizer will confirm the nature of the Prize.
If the winner satisfies the eligibility criteria for Hilo’s smart home service, the Prize will be hand-delivered by the certified electrician during the installation appointment. An agent of the Contest Organizer will contact the winner within five (5) working days after reception of their Declaration and Release Form in order to set up an appointment for installation. The installation appointment will be made within the fifteen (15) working days that follow the date of this call.
If the winner does not satisfy the eligibility criteria for a Hilo smart home service, the Contest Organizer will award a non-transferable promotional code enabling the winner to take advantage of a maximum credit of $200 towards their next order from Hilo. This promotional code is valid for a period of [60 days] starting from the date of its transmission.
 
10. GENERAL CONDITIONS
 
Verification. The Entry Forms and Declaration and Release Forms may be subject to verification by the Contest Organizer. All Entry Forms or Declaration Forms that are incomplete, unreadable, fraudulent, or recorded or submitted after the deadline, or that include an invalid email or phone number, or an incorrect answer to the mathematical skill-testing question, or which otherwise do not comply with these Rules, may be rejected and do not confer a right, as the case may be, to enter the Contest or win a Prize.
Disqualification. The Contest Organizer reserves the right to disqualify any person or cancel the entry of any person who participates or attempts to participate in this Contest using any means contrary to these Contest Rules or in such a way that is unfair to other participants (for example, by submitting a number of entries beyond the allowed limit, through piracy, etc.). Such a person may be reported to the relevant legal authorities.
Functioning of Contest. Any attempt to deliberately harm the Contest Website and/or any related site or to sabotage the legitimate running of this Contest represents a violation of civil and criminal codes. If such attempts are undertaken, the Contest Organizer reserves the right to reject entries from such participants and seek reparation as allowed by law.
Accepting the Prize. The Prize must be accepted as described in these Contest Rules and cannot be transferred, in whole or in part, to another person or substituted for another prize.
Functioning of Contest website. The Contest Organizer does not in any way guarantee that Facebook, Instagram or any related website is accessible or functional without interruption during the Contest Period, nor that such are free of any error.
Limitation of Liability: Prize Provider. Any winner selected for a Prize acknowledges that from the moment the Prize is awarded, all obligations relating to the Prize become the responsibility of the provider of the services included in the Prize.
Limitation of Responsibility: Contest participation. By participating or attempting to participate in this Contest, participants release the Beneficiaries from any responsibility for harm incurred as a result of their participation or their attempt to participate in this Contest.
Limitation of responsibility: Functioning of Contest. The Releasees are released from any responsibility relating to the improper functioning of any computer component, software or other communication channel, or relating to the loss or lack of network communications or relating to any other transmission that fails, is incomplete, or is incomprehensible, or that is erased by any computer or any network and which may limit or prevent any person from being able to participate in the Contest. The Releasees are also released of any responsibility for any damage or loss that may be caused, directly or indirectly, in whole or in part, by the loading of any webpage or software or otherwise, or from the transmission of any information for the purposes of participating in the Contest.
Modification of Contest. The Contest Organizer reserves the right, at its sole discretion, to cancel, terminate, modify or suspend, in whole or in part, this present Contest in cases where an event or human intervention arises that may alter or influence the Contest’s administration, safety, impartiality or conduct as intended in these Contest Rules, subject to the approval of the Régie des alcools, des courses et des jeux du Québec, if required.
Termination of Contest Participation. In a situation where the computer system is not able to record all Contest entries during the Contest Period, for whatever reason, or if participation in the Contest must be terminated, in whole or in part, before the expected end date provided in these Contest Rules, the draw will be made, at the discretion of the Contest Organizer, from amongst the entries recorded during the Contest Period or up until the date that Contest participation ends, as the case may be.
Prize limitation. In all cases, the Contest Organizer cannot be compelled to award more Prizes or to award a Prize in a manner that does not comply with or is not stipulated in these Contest Rules.
Authorization. By taking part in this Contest, all participants selected for a Prize authorize the Contest Organizer and its representatives to use, if necessary, their name, photograph, image, voice, place of residence and/or declaration relating to the Prize for the purposes of publicity without any type of remuneration or prior notice.
Communication with participants. No communication or correspondence will be undertaken with participants for the purposes of this Contest other than as outlined in these Contest Rules or unless initiated by the Contest Organizer.
Personal information. The personal information collected on participants for the purposes of this Contest will only be used to administer the Contest. No communication, for commercial purposes or otherwise, that is not related to this Contest will be sent to participants, unless otherwise consented to.
Ownership. The Declaration and Release Forms are the property of the Contest Organizer and will in no case be returned to selected participants.
Identification of participant. For the purposes of these Contest Rules, the participant is the person whose name appears on the Entry Form and it is to this person that the Prize will be awarded if they are selected and declared a winner.
Decision of Contest Organizer. Any decision on the part of the Contest Organizer or its representatives relating to this Contest is final and without recourse, with the exception of any decision of the Régie des alcools, des courses et des jeux du Québec with regard to those issues under its jurisdiction.
Disputes. Any disputes relating to the organization or conduct of a publicity contest can be submitted to the Régie des alcools, des courses et des jeux du Québec for a ruling. A dispute regarding the awarding of a Prize can be submitted to the Régie solely for the purposes of helping the parties reach an agreement.
Severability of clauses. If a section of these Contest Rules is declared or judged to be illegal, unenforceable or invalid by a court of competent jurisdiction, this section will be considered invalid, but all the other sections that are not affected will be applicable within the limitations permitted by law.
Language. In case of any divergence between the French and English versions of these Contest Rules, where an English version exists, the French version will prevail.
Deposit. The Organizer has duly paid the required fees relating to this Contest, as stipulated in the Act Respecting Lotteries, Publicity Contests and Amusement Machines.
 
11. OTHER
 
Contest participants must be on the lookout for fake accounts and fake contests. For the purposes of this Contest, the Organizer undertakes to never ask for any of the following:
 
  • the provision of banking information or credit card numbers so you can claim your Prize;
  • to call you so you can obtain an activation code to claim your Prize.
